Customer information

Pursuant to Article 21 (1) para. 1) of the Act of 30 May 2014 on consumer rights, we hereby inform you as follows:

  1. The total price (including delivery costs) of the goods ordered via the online shop operating at www.polkolonioeroyalwilanow.pl (the “Online Shop”), as well as the selected method and date of payment, are stated in the order confirmation;
  2. Lead time for orders placed via the Online Shop: from 1 to 14 days from the day of placing the order, depending on the Customer’s indication. Orders with next-day delivery can be placed until 4 p.m. Personal collection of ordered Goods can take place during the opening hours of The Art Makers in Warsaw at: Franciszka Klimczaka 1, 02-797 Warsaw.
  3. In all matters related to making transactions via the Online Shop, the Customer may contact the Seller via e-mail: royalwilanow.polkolonie@gmail.com;
  4. The Internet Shop is operated by The Art Makers Sp. z o.o. with its registered seat in Warsaw (02-797) at Franciszka Klimczaka 1, registered in the National Court Register (KRS) under the number 0000732388, NIP: 9512462375 (“Administrator”). Contact with the Administrator can be made at the above-mentioned address or by e-mail at: royalwilanow.polkolonie@gmail.com (“Seller”);
  5. Complaints about goods purchased via the Online Shop should be made via e-mail: royalwilanow.polkolonie@gmail.com;

  7. We would like to inform you about the possibility to use out-of-court ways of dealing with complaints about goods, e.g. by filing an application for mediation or an application for consideration of a case before an amicable court by the Customer after the complaint procedure has been completed (the application can be downloaded from the website: http://www.uokik.gov.pl/download.php?plik=6223). The list of Permanent Consumer Arbitration Courts operating at Provincial Inspectorates of Trade Inspection is available at: http://www.uokik.gov.pl/wazne_adresy.php#faq596. Out-of-court settlement of claims after the complaint procedure is free of charge;
  8. The goods ordered are covered by a warranty;
  9. The delivered goods are free of defects;
  10. The Customer’s obligations under the contract for the sale of goods shall continue until the goods and the delivery costs have been paid in full;
  11. The Customer, who is a consumer, may return the goods purchased from the Online Shop without giving any reason or incurring costs by submitting to the Seller a declaration of withdrawal from the contract of sale of goods in accordance with Article 27 of the Act of 30 May 2014 on consumer rights. The Customer may exercise this right within 14 days of receiving the goods. Sending the declaration before the deadline is sufficient to meet it. In the event of withdrawal from the contract of sale of the goods in accordance with the procedure indicated in this paragraph, the Customer shall be obliged to return the goods to the Online Shop, within 14 days from the date of submission of the declaration of withdrawal from the contract of sale of the Goods, in accordance with the procedure provided at the web address [__]. In the event of withdrawal from the contract of sale of the Goods, the contract of sale of the Goods shall be deemed not to have been concluded;
  12. If the Customer exercises the right to withdraw from the contract for the sale of goods after requesting the Seller to start providing services before the withdrawal period has expired, the Customer will be obliged to pay for the services provided until the withdrawal period has expired;
  13. The Seller shall reimburse the Customer for the goods returned by the Customer within 14 days from the date of delivery of the declaration of withdrawal from the contract of sale of goods to the Seller. The Seller may withhold reimbursement of payments received from the Customer until it has received the returned goods back or the Customer has provided proof of the returned goods;
  14. Withdrawal from a contract for the sale of goods may be made by completing the form for withdrawal from a contract for the sale of goods in accordance with the model attached to this information;
  15. The right of withdrawal does not apply to the consumer in the cases specified in detail in Article 38(1) of the Consumer Rights Act of 30 May 2014, inter alia with regard to contracts:
    • for the provision of services where the trader has supplied a service in full with the express consent of the consumer who has been informed before the performance of the service by the trader that he will lose his right of withdrawal after the trader has provided the service;
    • in which the object of the performance is a non-refabricated item produced to the consumer’s specifications or intended to meet the consumer’s individual needs;
    • where the object of the performance is an item that is perishable or has a short shelf life;
    • where the object of the service is an item supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons if the packaging has been opened after delivery.
